Placing Request Appeals in Orkney Islands
Orkney Islands Council handles school placing requests for its area - but if your child’s placing request has been refused, the appeal itself follows the same Scotland-wide framework as everywhere else: the Education (Scotland) Act 1980 (as amended), decided by an Appeal Committee.
How the appeal process works
An education authority can only refuse a placing request on one of a specific list of statutory grounds - for example that the school is at capacity, or that granting the request would seriously affect the education of pupils already there. Even where that ground is established, the Appeal Committee must still separately decide whether refusal is appropriate in all the circumstances, which is where your family’s own circumstances actually get weighed. You have 28 calendar days from the date on your refusal letter to lodge an appeal with the Appeal Committee - this is a fixed statutory period, not one the education authority can shorten or extend, but always confirm against the date on your own letter.
